    Thanks for posting the link to this poetry, its very relevant to the current situation. Always knew some lines of the poem but to read the actual one with its English translation is great. Do recall reading Dinkar's poems back in the school days, as part of the academic syllabus and some poems of Bachhan (the poet).

    Folks, it is indeed sad that perfect is turning out to be the enemy of good here, metaphorically speaking.

    Surely if the powers-that-maybe turn out to be antagonistic to highly skilled legal foreign workers in this country, it is a given that they are likely to turn this country into a place where none of us ever wanted to be.

    America has always been about opportunity for the smart and hard workers regardless of their background. It has attracted people because they saw their future brighter here. Take that away and not much else gets left behind.

    I have been in this country for 6 years now and still do not have more than a toehold here despite having put in my tax dollars which in some small fraction have helped pay for what some (who knows) people born here required help with getting. Moreover, if allowed to remain here, my project will yield for this country and the world a device that will help people save their eyesight.

    If he indeed was affiliated with the USCIS, I would want to hear his take on this even more. We are trying to understand what can and cannot be done in terms of self employment while on AOS and who better to answer this, than a USCIS representative.

    No one is trying to break the rules, just trying to understand what the rules are so they aren't unknowingly broken.

    And I know you were just joking, tee hee.

    Ok, in all seriousness - I used to confront with UN on Rajiv Khanna forums thinking that he is talking crap. But I later realized that he always tries to explain to you the other side of things and how perspectives differ.

    Back home - people think h1b visa is a gateway to USA. A lot of people think flight ticket, boarding pass, visa , passport everything in the same range.

    Before my wife came to US - someone told her - if she completes all USMLE successfully her status automatically changes from h4 to h1 - thats how people are there

    Once people come here perspective changes.

    Now among us, we share common ground so have same perspective - and thats what UN is trying to say - think from the other side. Look at the perspective from other side.

    You seem to be a rational person. You points are compelling and thats why we need to take some legal opinion on it.
    This does not apply. As long as BS+5 years progressive post-baccalaureate experience is ok for EB-2, the priority date recapture is as per law.

    It�s very easy and hip to blame everything in this world on desi companies but they are not completely to blame here. Consider this scenario. They are two ways to get H1,
    1. You are already in US, i.e. converting from F1 to Practical training, Practical training to H1. This is an easy option for companies because you are already in US so they come to campus interviews or fly you to there company headquarters for the interviews.
    2. Now what about the people who are outside the US. How are companies going to interview them, screen them and select them, you cannot give a job to somebody outside US by interviewing them on the phone, you cannot fly them to US for interview because it is costly and has visa issues. Desi companies have an advantage here because they are interviewing the people in India and those people are working for them before they file H1. Not just big desi companies like TCS, infosys, wipro etc take this route but even American companies like IBM operating in India are do this. Big companies like Microsoft, Intel, and Cisco do not get first crack at these filings but the labor pool is increased so they do have a chance to hire them when they come to US. People transfer all the time between companies when they are on H1. I know a lot of people who are working in Cisco and Microsoft who came to US on H1 through desi companies but later on accepted full time positions in Microsoft, Cisco and other companies.

    Now I am not defending desi companies nor did I ever work for desi company but I am telling you the reality. Even mom and pop desi companies are doing some service by providing a medium for employees and employers through consulting services. The only and biggest gripe I have against desi companies is that they are exploiting the h1 employees by keeping bigger margins on the H1 hourly rate.

    Now if you want to reform H1, you can do things like give H1 based on credentials like UK does, you get points based on years of experience, education level (Masters, phd, bachelors etc) and give the people the ability to change jobs at will during the period of H1, that will eliminate a lot of exploitation and make it easier for companies to hire people on h1. This will eleminate some mom and pop desi consulting companies which are the middle men.

    The law makers (democrats) who introduced this so called law to reform H1 are actually trying to kill H1 in the name of reform. They don�t have the backbone to come out and say H1 should be abolished but instead they are taking the back door to kill the H1 through these draconian measures.

    You, being an Indian by nationality, hate India so much and I can only imagine what a Pakistani terrorist would think! You were born in India, got your education from there, have friends and family there, but still, in a heart beat, side with the terrorists that kill innocent Indians.

    I've heard this numerous times and I now know it for a fact - Muslims love their religion more than the country. It is, now even more clear, who MOST Indian muslims will side with in case of a dispute between India and Pakistan.

    How old is the technique of discrediting my links to win the argument. Of course, if I tell you of all the atrocities of Indian army in Kashmir, or punjab, or assam, to you I am a muslim, and my default I hate India. Of course, it wouldn't matter if good old amnesty internationl would raise a red flag against india...

    In a sprawling conference hall in a prison on the outskirts of India's southern city of Hyderabad, a dozen-odd prisoners are tapping away furiously on computer keyboards.

    It is an unusual sight: the prisoners, mostly sentenced to life for murder, are training to become workers in a unique outsourcing unit that is coming up at the impressive 43-acre Cherlapalli jail.

    They are in the middle of a typing accuracy and speed test, having been set a target of typing 35 to 40 words a minute. Other prisoners are shadowing them.

    Of the 2,000-odd inmates, nearly 70 are engineering graduates, say prison authorities.

    By end of January, they believe, India's first BPO [business process outsourcing] unit in a prison will begin working with 50-odd inmate "employees" from an in-house meditation centre which is being transformed into a factory.

    'Expecting orders'

    It will specialise in non-voice based, off-line outsourcing work like digitising records, legal documents, scripts, manuscripts and text books, and medical transcription, says K Mohan Menon, a manager with Radiant Info Systems, a US-based info-tech company which is assisting the venture.

    It helps that Hyderabad is a BPO hub, generating some 50 million rupees ($1.1m; �717,922) annually in revenues from non-voice based business alone.

    "We cannot let prisoners get online and communicate with the outside world. So we opted for an offline business. Some people and companies have already shown interest and we expect some orders soon," says prison chief G Jayawardhan.

    The convicts get a paltry 15 rupees [33 cents] per day for other work like making steel furniture or working on looms in the prison, but authorities expect to pay them 100 rupees [$2.2] to 150 rupees [$3.32] a day for working in the BPO unit.

    M Nageshwar, 37, a software engineer who worked with a company for 10 years before he ended up in prison, is leading the pack of convicts who are training to work at the unit.

    He was found guilty of killing his wife - he says she committed suicide - three years ago and sentenced to life.

    Mr Nageshwar has contested his conviction in the Supreme Court.

    "I am excited about the project. Educated people like me can easily slip into depression when they are incarcerated. It is a relief for convicts like me and a good opportunity to prove ourselves," he says.

    "Also, remember," he whispers, "an idle man's brain is a devil's workshop."

    G Rama Rao, who was sentenced to life 15 months ago for murdering a political opponent - he says it was a case of "political conspiracy" - echoes a similar sentiment.

    Mr Rao is a postgraduate in commerce from a leading university and owns a rice mill, which his family runs in his absence.

    "As an educated man, I can't find good work in a prison and get bored. I can't do all the factory work here. At my rice mill, I did my accounts on the computer. So I will use my skills to spend time better," he says.

    'Living in hope'

    Most convicts believe that their work experience with the outsourcing unit will fetch them jobs if and when they are released.

    Ravi Kumar, 26, was an army clerk for seven years, before he ended up shooting a colleague dead while he was posted in Indian-administered Kashmir.

    A commerce graduate, Mr Kumar says he has worked on computers in the past.

    "When I come out of prison, this is going to help me," he says.

    Twenty-four year old Mahesh Goud, who has been in the prison for 14 months in connection with the murder of a friend, is an electronics graduate.

    He worked in a hydroelectric plant as an electrical engineer for nearly two years, earning $280 a month till the crime.

    "I am feeling useful again. I am spending time more fruitfully. I hope this is a success," he says.

    Bank manager Ratna Babu, 53, was working with a state-owned bank before he was arrested on charges of misappropriation of money, a charge he denies.

    The case dragged on for 13 years before he was sentenced to six years in prison about a year ago.

    Mr Babu says he began learning computers only three months ago.

    "After I am free I will never get a job in a bank. I want to work for a BPO then. This training will stand me in good stead.

    Mr Goud agrees wholeheartedly.

    "It will help in my future. All of us will be released one day. All of us have to go out and find work then. This experience will help us. We all live in hope, don't we?"

Temples were razed to the ground and villages were burned. Those who refused to convert to islam were either killed or raped if you were women.     Its sad that even today in India the muslim which is a minority community is holding the whole country back.. they continue to fight the hindus where ever they can and whenever they can in places like Kashmir and unfortunately the Indian leaders and Hindu community continue to follow the principle of Non Violence which is not working.

    The islam religion is not a religion of unification on the contrary the religion teaches the Muslims that non-Muslims are infidels and that they should be killed and that is the reason why Isalm was instituted through coercion and violence. So lets face Islam is everything but a religion of peace.. and yes I think the world is now waking up the violence of this religion and sooner or later the Islamic religion has to evolve into a moderate religion, failing which it will die its own death..

    I had lived in gujarat for 40 years and all these years right from 1965 every year there was communal riots ( sepcially starts on Rath Yatra ) and more Hindu got killed then Muslims , just once the more muslim got killed then Hindu , and you see the whole world come to know about that. Where were every one including you for the last 40 years ??

    Members working for consulting companies can talk to their employers about this. Let us know their response.

    The employers are not gonna be worried about it..

    Many of these restrictions were passed for the L1 program some 1 year back.
    I know many people on L1 still working at client sites and no one even saying peep about it...

    This is what I heard from a friend who is a employee of a NYSE listed firm with 100+ million turnover...He and a few more on L1 raised this question to their company lawyer.. The company lawyer had many arguments to defend their position. For example 'If DOL raises a question, the company would say we have offices at multiple locations one at each client site..'There is a small army of lawyers on the company's retainer and they are not afraid at all...They told the L1 employees to calm down and leave it to them....There are many creative ways in which to structure the consulting deals and the law is worth the paper it is printed on.....

    DOL is gonna have 200 more employees for the enforcement...200 is nothing frankly...Then they have to funded every year...May be congress would not fund the additional 200. Governments never have the will to go after the businesses....So the law would look very restrictive on paper and no real impact.....I know as a fact that the L1 restriction law had absolutely no impact...

    The net scenario would really depend on what happens during the first year or so...Suppose USCIS starts denying applications and they deny 10K applications...Then 5K and more of these appeal the denial and in the end sue the USCIS ..Do not forget to remember that CIR is passed and the USCIS is loaded with the legalization workload...The appeals system and the immigration courts would get swamped with these cases...As long as the case is in the appeal or the court, they employee continues to work.....The employees would have problems with the Drivers license and like but some would stick it out...Once USCIS appeals system and courts system gets overloaded with the case load...USCIS and the US attorneys would lose their will power to try to enforce the law......
    I do not know the details of judicial review for H1 denials and I did not see anything in this law curtailing the judicial review of H1B petitions...So a lot is subjective about the law.....Many laws never have their intended impact it just goes sits in some corner...

    There you go - "inflation"! This is another reason why investing in a house makes so much sense (iff your gc/job etc are sorted out).

    Let's say you buy a house today for $300,000, and you're paying $2,000 towards your monthly mortgage. Even if you don't build too much equity on it because of the falling real estate, you will STILL come out better because inflation will make sure that your monthly payments of $2,000 in 2019 will really become $1,500 in today's money.

    But if you continue to rent, you will pay let's say $2,000 today in rent, and 10 years from now you'll be paying $2,500, and you don't have a home to call your own!!!

    During times of inflation, commodities, home, etc are the winners. you are partly correct in my view ....but to buy when prices are falling is a sure shot loser ...
    even if prices are stable or lower than the rate of inflation ..you will be losing money on the cost of the house ( 300K + for many homebuyers ..since you pay interest on the cost of the house)..for home buying to be a good investment, it needs to appreciate more than the rate of inflation (that seems years away from now)

    for e.g the person above who put in almost 80K in down payment ..
    1) if that downpayment was invested in better way ..then he could easily get 10% returns (u need to do some homework though) ...that means around 600 - 700 per month.
    so his effective rent is around 1200 per month.
    2) 5 years from now, rent may still be the same (or lower) ... it depends a lot on supply and demand on rental units too
    in majority of cases, we end up buying a house further away from our work ..that means additional 300 - 400 in gas and vehicle wear/tear per month.
    add property taxes, HOA fees, extra utilities, mntc, realtor fees, termite, lawn maintenance, long term prospects of USA, immobility (additional 800 - 1500 dollars) etc etc and you can easily say that home buying / investment in real estate is not a good bet (in USA atleast).
    if you are on temporary status - then add extra $200 - 300 risk premium per month as invisible risk cost (for risks plus extra headaches )
    so home buying should be more of lifestyle choice and not an investment point of view (in countries like India, singapore it is different since demand will always be strong for a long long time).
